These terms govern your use of the Vyra online store at vyrastrong.com and any purchases you make from us.

1. Who you are buying from

Vyra is operated by Nidhin Tamil as a sole-trader business in Australia (formal business registration in progress). When you place an order, your contract is with Nidhin Tamil operating as Vyra. Our contact email is hello@vyrastrong.com.

2. Eligibility

You must be 18 years or older to place an order. By placing an order you confirm you are 18+.

3. Order acceptance

An order is not accepted until we send you an order confirmation email. We reserve the right to decline any order, for example, if a product is out of stock, if there is a pricing error, or if we suspect fraud. If we decline an order after payment, we issue a full refund.

4. Prices and payment

All prices are in Australian dollars (AUD). Prices are subject to change but the price at order placement is what you pay.

GST: Vyra is not currently registered for GST. Prices shown do not include GST. If we register for GST in future, this section will be updated.

Payment is processed by our payment gateway (when enabled). Vyra does not see or store your full payment details.

5. Shipping

Shipping is covered by our separate Shipping Policy at /policies/shipping-policy. In summary, products ship from our overseas warehouse; typical delivery to Australia is 7–21 business days from order placement; tracking is provided.

6. Returns and refunds

Covered by our separate Refund Policy at /policies/refund-policy. Australian Consumer Law (ACL) statutory guarantees apply and are not excluded by these terms. You have rights under the ACL that we cannot contract out of, including the right to a refund or replacement for major faults.

7. Product use

Vyra is a wellness device, a hand-held breathing trainer with progressive resistance. It is not a medical device. We are not medical advice. If you have any diagnosed respiratory condition (asthma, COPD, sleep apnoea, etc.), are pregnant, or have any concerns about whether resistance breathing exercise is appropriate for you, please consult your doctor before use.

Use the product as described in the included instructions. Misuse may result in dizziness or discomfort.

8. Reviews and user content

If you submit a review or other content (via Judge.me or directly), you grant Vyra a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content on the Vyra store and in marketing materials, with attribution to your name or initials as you provided. You retain ownership of your content. You can request removal at any time.

You must not submit reviews that are false, misleading, defamatory, infringing on someone else's rights, or that violate the Australian Consumer Law's prohibitions on fake testimonials.

9. Intellectual property

The Vyra name, logo, store design, photography, and copy are owned by Nidhin Tamil. You may not reproduce or use these for commercial purposes without permission.

10. Limitation of liability

To the maximum extent permitted by law (and except for ACL statutory guarantees which cannot be limited):

  • Our total liability for any claim related to a product is capped at the amount you paid for that product.
  • We are not liable for indirect, consequential, or special damages.

ACL statutory guarantees are preserved. If a product has a major fault you are entitled to a refund or replacement regardless of these limits.

11. Privacy

How we handle your personal information is covered in our Privacy Policy at /policies/privacy-policy.

12. Disputes

If you have an issue with an order:

  1. Contact us first at hello@vyrastrong.com. We aim to resolve issues within 14 days.
  2. If we cannot resolve, you can contact the ACCC (accc.gov.au) or your state's consumer affairs body.
  3. Final disputes are governed by the laws of New South Wales, Australia, and subject to the jurisdiction of NSW courts.

13. Changes to these terms

We may update these terms. The "Effective date" at the top reflects the most recent revision. Continued use of the store after material changes means you accept the new terms. We will notify customers with accounts of material changes via email.

14. Severability

If any clause of these terms is found unenforceable, the rest of the terms remain in force.
